LIABILITY WAIVER AND RELEASE AGREEMENT

This Liability Waiver and Release Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of MOUV USA LLC, its owners, managers, employees, instructors, contractors, agents, and affiliates (collectively, the “Released Parties”).

1. Acknowledgment of Risk

Participant understands and acknowledges that participation in Pilates, Reformer Pilates, Hot Pilates, Barre, fitness classes, private sessions, workshops, and related activities involves inherent risks, including but not limited to:

Muscle strains, sprains, soreness, or injury
Falls, dizziness, fainting, dehydration, overheating
Aggravation of pre-existing injuries or conditions
Equipment malfunction or misuse
Physical or emotional stress

Participant voluntarily chooses to participate with full knowledge of these risks.

2. Health Representation

Participant represents and warrants that:

They are physically and mentally capable of participating in fitness activities
They have no medical condition that would prevent safe participation, or they have consulted a licensed physician prior to participation
They agree to stop exercising immediately if they experience pain, dizziness, shortness of breath, or discomfort and will notify an instructor

MOUV USA LLC does not provide medical advice or diagnosis.

3. Assumption of Risk

Participant voluntarily assumes full responsibility for all risks, injuries, or damages, known or unknown, which may occur as a result of participation in any activity at MOUV or through MOUV-hosted events.

4. Release and Waiver of Liability

To the fullest extent permitted by law, Participant hereby releases, waives, discharges, and covenants not to sue the Released Parties from any and all claims, demands, causes of action, damages, losses, costs, or expenses arising out of or related to participation in MOUV activities, including but not limited to:

Personal injury
Property damage
Illness or death

This release applies even if caused in whole or in part by the negligence of the Released Parties, except where prohibited by New York law.

5. Indemnification

Participant agrees to indemnify and hold harmless the Released Parties from any claims brought by third parties arising from Participant’s conduct, participation, or violation of Studio policies.

6. Use of Equipment & Facilities

Participant agrees to:

Use all equipment properly and as instructed
Follow all safety guidelines and Studio rules
Acknowledge that improper use may result in injury

MOUV USA LLC is not responsible for injuries caused by misuse of equipment or failure to follow instructions.

7. Photography & Media Release

Participant grants MOUV USA LLC the irrevocable right to photograph, video record, or otherwise capture Participant’s likeness during classes or events and to use such media for marketing, social media, advertising, and promotional purposes, without compensation.

If Participant does not consent, they must notify the Studio in writing prior to participation.

8. Minors

If Participant is under the age of 18, this Agreement must be signed by a parent or legal guardian, who assumes full responsibility for the minor’s participation.

9. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of New York.

10. Severability

If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11. Entire Agreement

This Agreement constitutes the entire understanding between Participant and MOUV USA LLC regarding liability and risk and supersedes all prior agreements or representations.

12. Acknowledgment & Acceptance

By signing below, Participant confirms that they have read, understood, and voluntarily agreed to this Liability Waiver and Release Agreement.
